Like-Kind Exchanges Under IRC Code Section 1031
Whenever you sell business or investment property and you have a gain, you generally have to pay tax on the gain at the time of sale. IRC Section 1031 provides an exception and allows you to postpone paying tax on the gain if you reinvest the proceeds in similar property as part of a qualifying like-kind exchange. Gain deferred in a like-kind exchange under IRC Section 1031 is tax-deferred, but it is not tax-free.

Taxpayers should be wary of individuals promoting improper use of like-kind exchanges. Typically they are not tax professionals. Sales pitches may encourage taxpayers to exchange non-qualifying vacation or second homes. Many promoters of like-kind exchanges refer to them as -free” exchanges not “tax-deferred” exchanges. Taxpayers may also be advised to claim an exchange despite the fact that they have taken possession of cash proceeds from the sale.

Country Real Estate Columns by Curtis Seltzer
Curtis Seltzer, 61, has lived and worked in the country for the better part of 35 years. Land Values: Average Farm Real Estate Value by Year, from USDA Land Values are up! The USDA has published its new average sold figures for agricultural land values. The values has show an increase as they have for many years. This increase indicates the good long term investment that rural land can be. The 2008 average price is $2170 per acre which is over double what it was in 1999 at $1030 per acre.
